CLIENT SERVICES AGREEMENT & TERMS AND CONDITIONS

Effective: Date of Purchase

This Client Services Agreement (the “Agreement”) is entered into by and between Av8r Strength, LLC (“Company”) and the individual purchasing or accessing Services (“Client”). By purchasing or using any Services, Client agrees to be legally bound by this Agreement.

1. Nature of Services & No Medical Advice

The Company provides fitness, health, nutrition, and performance-related information and programming for educational purposes only.

The Company does not provide medical advice, diagnosis, or treatment. Nothing provided should be interpreted as a substitute for professional medical guidance. Client should consult a qualified healthcare provider before beginning any program.

2. Medical Clearance & Assumption of Risk

Client confirms they are physically and mentally capable of participating in the Services and have obtained medical clearance where appropriate.

Client understands that participation in fitness and performance training carries inherent risk, including but not limited to injury, illness, or physical strain.

Client voluntarily assumes all risk associated with participation.

No outcomes or results are guaranteed. Individual results will vary.

3. Limitation of Liability & Indemnification

Client agrees the Company is not liable for any injury, loss, or damages arising from use of the Services.

Client agrees to indemnify and hold harmless the Company from any claims arising from participation in Services or violation of this Agreement.

4. Intellectual Property

All Company materials, including programs, documents, videos, and training content, are proprietary and protected intellectual property.

Client may not copy, share, reproduce, distribute, or resell any materials without written permission.

All materials are for individual use only.

5. Eligibility

Services are available only to individuals 18 years or older. By purchasing, Client confirms they meet this requirement.

6. Termination

The Company reserves the right to terminate access to Services without refund if Client violates this Agreement, including misuse or distribution of materials.

7. Subscription Services (If Applicable)

Certain Services may be offered on a recurring subscription basis.

7.1 Billing

Subscriptions are billed automatically according to the selected billing cycle. By enrolling, Client authorizes recurring charges until cancellation.

7.2 Cancellation Policy

Client may cancel at any time. To avoid being charged for the next billing cycle, cancellation must be completed prior to the next scheduled renewal date.

Upon cancellation, Client will retain access through the end of the current billing period. No further charges will occur after cancellation is processed.

7.3 Responsibility for Cancellation

It is the Client’s responsibility to ensure cancellation is completed before the next billing cycle. The Company is not responsible for charges resulting from late cancellation.

7.4 No Retroactive Refunds

All subscription payments are non-refundable once processed, including cases where cancellation was not completed before renewal.

8. Privacy

Client data is handled confidentially. The Company does not sell personal information. Data may be used in anonymized form for internal improvement and business operations.

9. Dispute Resolution & Governing Law

This Agreement is governed by the laws of the State of Florida.

Any disputes shall be resolved through binding arbitration in Brevard County, Florida. Client waives the right to a jury trial or class action.

10. Entire Agreement

This Agreement represents the full understanding between Client and Company and supersedes any prior agreements.

If any provision is deemed unenforceable, the remaining provisions remain valid.

11. Media & Content Release

Client grants the Company permission to use submitted content (including testimonials, images, and progress updates) for marketing, advertising, and promotional purposes without compensation.

Client waives any claims related to use of such content.

12. Refund Policy

All products are digital downloads and are non-refundable once purchased.

By completing purchase, Client agrees to this policy.
